Terms and Conditions of Trading

Acceptance of this quotation automatically constitutes acceptance of the following Terms and Conditions of Trading. The customer guarantees to comply with and abide by the Terms and Conditions contained in this document.

Booking Confirmation- An aircraft charter booking will be secured when you provide Corsaire Aviation with a 20% deposit of the total amount of the charter. This deposit will be fully refundable until 14 days prior to the departure date.

Payment- For clients without a trading account, full payment is required 7 days prior to departure, unless an alternative arrangement is made at the time of booking. Payment can be accepted by direct bank transfer, credit card (Visa and MasterCard), cheque or cash. Please note, for cheque payments, additional time should be allowed for the cheque to clear into the Corsaire Aviation’s bank account. For clients with a trading account, an invoice will be issued upon the return of your flight. Payment terms are 7 days. If the Customer defaults in payment of any account, then ALL monies owing to Corsaire Aviation shall be immediately due and payable, and in addition; the debt may be subject to collection charges, and an interest charge at the rate under The Magistrates Court (Civil Proceedings) Act 2004 and Civil Judgements Enforcements Act 2004 for each day up to and including the date on which the debt is paid in full; and any expenses incurred by Corsaire Aviation in recovering the monies due, including but not limited to Solicitors charges, debt collectors fees, Court costs, process serving costs, disbursements, and dishonour fees.

Cancellation- Should you require the charter to be cancelled or changed please notify Corsaire Aviation immediately. Flights cancelled between less than 48 hours prior to departure will be liable for 75% of the quoted charter price. Flights cancelled less than 24 hours prior to departure will be liable for 100% of the quoted charter price.

Cancellation Due Weather- Corsaire Aviation maintain the highest level of safety and passenger comfort. Cancellations due weather are 100% at the discretion of the Pilot in Command of the flight. Flights cancelled by Corsaire Aviation due to weather will be rescheduled for a suitable time for both parties, if rescheduling is not an option, the amount paid will be credited to the client in the form of a voucher. If the pilot deems the weather suitable for the flight to take place, and the client decides to cancel the flight against the pilot’s advice, the flight will be non-refundable and the client will forfeit their flight.

Additional Costs- Any additional flying above that in the quotation (i.e. site flyovers, diversions etc) will be invoiced in addition to the quotation given at Corsaire Aviation’s discretion.

Jurisdiction- Regardless of any application to the contrary, the operations of this charter are governed by the Laws of Western Australia, and any action instituted by Corsaire Aviation against the client, and/or any action instituted by the client against Corsaire Aviation, will take place under the Laws of Western Australia, and in the Courts, (regardless of the amount) which are located in the City of Perth

Further Items to Note- Flight Crew hours are limited by Civil Aviation Regulations and all charter operations will be operated in accordance with those regulations. Corsaire Aviation accepts no responsibility for weather conditions or any impact weather conditions may have on any charter. Extreme temperatures may require flights to be delayed or to have payload reduced to comply with aircraft limitations. All passenger flights require actual passenger weights. Actual passenger weights should be supplied on confirmation of flight or before due date of departure. Baggage weight restrictions apply and will be notified in the quote or by email before departure date. Any baggage that exceeds the maximum quoted weight or is not in the form of a soft bag and is presented in a hard form may be rejected at the discretion of the Pilot in Command or their delegate. Sleeping accommodation that may be required is to comply with Flight and Duty Legislation. Sleeping accommodation is determined to be a single room with a bed and facilities to control light and temperature.
